PRIVACY RULES

HIPPA guarantees cerain rights are afforded to patients,  these include:

-Right to receive from their health care providers a statement of privacy policy

*This may be provided electronically or in paper form.  If provided electronically the patient may

request a paper version of the same.

*Provider is required to receive written confirmation from the patient that they have received the

privacy policies of the office.

- The right to access, inspect and copy their protected health information (PHI)

*Not all requests MUST be complied with and not all portions of the record are subject to access, inspection or copying.

- The right to amend their protected health information (PHI)

* Requests for the same must be complied with within 60 days

- The right to request restrictions on certain uses and disclosures for treatment,  payment or health care

operations (TPO)

*Providers are not required to agree with the request,  but if agreed to the provider is bound to the restriction.

- The right to confidential communications by alternative means,  or to alternative locations.

* The patient may request that the be contacted in specified manner (no voicemail or tape messages for example)

* The patient may request to be called at work or never at work.

*The patient may request communication to another address.

* This may be disregarded if it considered an element of patient safety.

 - The right to know the name of a person in the office to whom questions or complaints about privacy should be addressed.

- The right to know how and where to contact the person referenced above.

-The right to know that the patient may lodge their complaint with the Department of Health and Human Services through the Office of the Patient Advocate.

HIPPA provides certain exceptions to tights afforded to access, inspect or copy patient records, 

Including:

- Practitioner notes-chart notes

- Information developed for legal activity including civil and criminal actions.

- Information related to the Clinical Laboratory Improvements Act (CLIA)

- Information obtained from another source that is viewed as confidential where release would compromise the confidence.

 

HIPAA requires certain expectations from providers including:

- Assure that patients are able to exercise their rights with respect to protected health information.

- The development and Implementation of policies and procedures to assure that the privacy rights of patients are protected.

Disclosures permitted without authorization that does not violate the privacy rules:

- Fulfilling the request of adult protective services or other governmental social services agencies.

- Responding to state and federal agencies with respect to HIPPAA  privacy compliance

- Bona fide law enforcement related requests
